1. Acceptance of the Terms
By creating an account, accessing, or using CucuDay, you agree to these Terms and Conditions ("Terms").
If you do not agree, you must not use the platform.
2. Service Description
CucuDay is a platform that provides tools for business management, point of sale,
administration, and, where applicable, connection between buyers and sellers through the Internet.
CucuDay may update, improve, or modify its features at any time.
3. Account Registration and User Responsibility
To use certain features, you must create an account by providing truthful,
complete, and up-to-date information. You are responsible for:
• Maintaining the confidentiality of your username and password.
• All activities carried out under your account.
If you suspect that someone else is using your account, you must notify us immediately.
4. Permitted Use
You agree to use CucuDay solely for lawful purposes and in accordance with applicable regulations.
In particular, you may not:
• Use the platform for fraudulent, illegal activities or that infringe third-party rights.
• Attempt to gain unauthorized access to systems or accounts of other users.
• Introduce malicious code, viruses, or carry out attacks of any kind against the platform.
5. User Content
The data, products, descriptions, prices, images, and all other information you register on CucuDay are
under your sole responsibility. You guarantee that you have the rights to use such content and that it
does not infringe intellectual property rights, privacy, or any other applicable laws.
6. Intellectual Property
All trademarks, logos, designs, code, and other elements of the CucuDay platform are the property of
their respective owners and are protected by intellectual property laws. You do not acquire any
ownership rights over the software or the CucuDay brand by merely using the service.
7. Plans, Payments, and Commissions
If paid services are offered, prices, features, and commercial conditions will be clearly indicated
on the platform. Any applicable commission, charge, or fee will be communicated in advance.
CucuDay may modify such prices in the future, notifying users through the portal.
Fair Use and Operational Limits of the Plans
Some CucuDay plans include the word “Unlimited” for certain resources. This term is understood under a fair use scheme (“fair use”) and reasonable technical limits.
“Unlimited” use means that the user may use such resources without a fixed monthly cap, provided that their behavior:
• Does not involve abusive automation, massive resource consumption, denial-of-service attacks, data mining, scraping, or other practices that exceed the normal commercial purpose of the service.
• Does not negatively affect the stability, performance, or security of the platform or other users.
• Is consistent with the usual usage of a normal business.
CucuDay reserves the right to:
• Apply temporary limits, blocks, throttling (“rate-limit”), or preventive suspension when atypical or abusive use is detected.
• Establish dynamic technical limits, even on plans marked as “Unlimited”.
• Request migration to a higher plan or to a “Custom / Dedicated” plan when the user’s consumption exceeds normal operating parameters.
Failure to comply with this fair use policy may result in temporary suspension or permanent cancellation of the account without entitlement to a refund.
8. Limitation of Liability
CucuDay makes reasonable efforts to maintain the continuity and security of the service, but does not
guarantee uninterrupted availability of the platform or the total absence of errors.
To the extent permitted by law, CucuDay shall not be liable for indirect, incidental, special,
consequential damages or loss of profits arising from the use or inability to use the service.
9. Accounts, Suspension, and Cancellation
CucuDay reserves the right to suspend or cancel your account, in whole or in part, when it detects
improper use, non-compliance with these Terms, or activities that may affect other users or the
security of the system.
You may request the cancellation of your account at any time from the "My Account" section of
the platform. Cancellation implies the permanent deletion of your data, in accordance with the
Privacy Policy
10. Third-Party Links
The platform may contain links to third-party websites. CucuDay does not control or endorse such sites
and is not responsible for their content, privacy policies, or practices.
11. Modifications to the Terms
CucuDay may modify these Terms at any time. Any modifications will be published at
https://www.cucuday.com and will take effect upon publication. Continued use of the platform after
such changes implies acceptance of the new Terms.
12. Governing Law
Unless otherwise stated in specific conditions, these Terms shall be interpreted in accordance
with the applicable legislation in the jurisdiction corresponding to the domicile of the service owner.
